In advance of their meeting with the Saugerties Planning Board tomorrow, Tuesday October 21st, SOLO have submitted various documents to the Board.
Here is the second draft:

The new draft calls for road access from Route 212. Cottontail Lane access is no longer proposed. Further, the new draft takes advantage of the new road profile (and the DEC Negative Declaration about wetlands, see below) to propose another lot. This brings the total proposed units to nine. The NY State DEC has made a Negative Declaration as to regulated freshwater wetlands:

The NYS DEC makes sure to note that this is a Negative Declaration only as to state regulated freshwater wetlands. Federal wetlands may be a different matter. (File also available here)
The engineers also sent a letter to the Board detailing the various changes since last they presented:

Overlooking the typo in the subject line, we see that here they enumerate the changes. The DEC wetlands declaration, the new road, and the extra house. (File also available here)
Important Note: The plan now calls for 9 houses (up from 8). This is based on two factors. The first is the redrawn profile for the road. The second is based on a claimed “removal of any potential wetland buffer restrictions”. This should be examined very carefully, as the NY DEC makes plain that theirs is a declaration only about state regulations, not federal. We assume that, should these wetlands be federally regulated, the buffer restrictions will apply. Federal wetlands do not have a buffer.
Reminder: Solo Holidays LLC will have this in front of the Saugerties Planning Board at the Tuesday October 21 meeting. The meeting starts at 7:30pm and there are two Public Hearings to start the session.
